Hereinafter, the legal terms that regulates the mandatory agreement between the parties will be described, having them first identified as users: “Host” or “Guest” they can also be called as “he or him” regardless of the gender. On the other hand the  “Bungalulu” which can also be also called as “Bungalulu.com” or “admin”. This contract will define the rules regarding the access to the platform, downloads, registration, privacy, use and storage of the application. Any person or legal entity who accesses the platform and makes use of it, whether this affiliate or not, is understood as the user.  Bungalulu is a company legally incorporated in the United States of America under the legal name of NY DYNAMIC TRADE LLC or BUNGALULU, and it represents the software developer.  Bungalulu reserves the right to update. modify and re-publish these policies on Bungalulu.com at any time without giving a personal notice to the users since the platform is being exposed in a public domain, available 24 hours a day, 365 days a year, therefore, the users acknowledge and accept that it is their solely responsibility to review these legal terms often and understand its meaning and effects. Bungalulu will publish a banner on Bungalulu.com giving a general notice to the users in case any modification to the legal terms has been made, which will be exposed during 5 business days after the modification was issued.  In any case where these legal terms have been modified, the user will have the right to refuse the modifications by sending an email refusing the changes made to bungalulu’s legal terms in a period of time not more than 5 business days after the general notice was exposed through a banner on bungalulu.com. In cases of refusal to the changes, Bungalulu reserves the right to either keep the original legal terms in effect only with the specific user or decide to terminate the agreement. Bungalulu will send a final decision to the user’s email in a period of time not more than 5 business days after getting the refusing request. In any case this agreement can be terminated for any party by sending a contract termination request to contracts@bungalulu.com without acknowledgement of receipt. If the termination has been requested, the parties agree and undertake to completely perform their duties with respect to any contract of stay that would be in effect by that time. The users accept and acknowledge that these legal terms cannot be assigned or transferred in any way without express consent from Bungalulu and also that Bungalulu reserves the right to assign or transfer this contract with its sole consent.   

Bungalulu has all rights reserved for its website and mobile sites, including any kind of information, logos, pictures, software among many other things. The users agree and undertake that in no event shall they make unauthorized copies of Bungalulu’s software, decompile, reverse engineer, disassemble, modify, hack, exhibit, sell, or otherwise use any element of Bungalulu’s property without authorization given by Bungalulu.     

Bungalulu offers users the possibility to download and use a website or mobile application that allows users to become a host listing their properties for vacation rental or be a guest and have the possibility to search, book and rent a holiday property throughout the world, being able to have access to the platform 24 hours a day, 365 days a year.  However, Bungalulu, is not a real estate brokerage, nor does it act as such, does not own listed properties or shows that in person, nor does it manages or contracts on said listed properties, nor does it participate in the negotiation which must be considered to occur only and exclusively between the host and the guest, Bungalulu only provides an online platform that connects users (hosts and guests) who act under their own responsibility,  following the policies established for the user’s community. Bungalulu is also not an insurance company, nor does it offer any type of coverage for incidents, loss or damages to property, persons, liability or third parties. Keep in mind that some places in the world may not be safe to visit or sometimes safety places can become unsafe, the user declares and accept that he assume total risk and responsibility for himself and for his group of visitors by choosing his trip destination, and he also declares and accept that Bungalulu is not responsible for any crime committed against persons or property while enjoying the leased property through Bungalulu’s platform.  Bungalulu only provides the use and enjoyment of the platform for its users who undertake to pay the invoice including the established fee each time they make contracts within the platform and to follow the user’s community guidelines.  Bungalulu will maintain an accessible and transparent platform fostering a friendly user community based on the good faith of the parties.         

The policies defined in this agreement are supplemented by our Privacy Policies, Payment Terms and Cancellation and Refund Policies, which should be considered an integral part of this agreement.          

Users must create an account to access the Bungalulu platform, either through its website bungalulu.com or through the use of mobile applications that can be found and downloaded in Google Play Store and Apple Store. The user undertakes to provide his reliable personal information and to keep it updated at all times, likewise the user undertakes to link or add as preferred or important contacts his personal email that has been provided to sign up for bungalulu.com with the list of emails provided by bungalulu.com in these legal terms,  in order to avoid losing any communication sent. The user accepts and acknowledges that he exonerates from all responsibility to Bungalulu for any lost or not reviewed communication that had been directed to Spam or Not Important Email.

Users must comply with local or national laws and they also accept they are solely responsible in cases of any regulatory breach.  The user declares and accepts he totally relieves responsibility from Bungalulu in cases of breach of the law.        

With the use of the Bungalulu platform the users can find the property that really suits their needs, regardless of their budget or whether or not their next trip is going to be in a cosmopolitan city or in a secluded corner in the world, Bungalulu will give them access to countless publications so that they can meet their desired goal. Users will be able to look at the descriptions, photos and videos of the publications and they will also have the possibility to establish contact with the hosts even before reserving the property.         

Users who use the platform as guests will be able to search for properties, having the possibility of searching by applying certain filters such as number of guests, type of property, number of rooms, price, availability, certain dates, among many other novelties offered by the platform.        

Once the user found the property he wants to rent, he can send a request or make the reservation depending on the listing policies, he also undertakes to pay all the costs generated by the invoice, through the payment methods established by the platform,  including the price of the night multiplied by the number of days of the stay,  any applicable tax or fees, mandatory deposit or cleaning service fee if established, as well as Bungalulu's fees for the use of the platform, the user also accepts that Bungalulu may deduct from the selected payment method amounts for damages caused to the property that have been demonstrated were caused by the guest on purpose or negligent manner and determined through Bungalulu's dispute resolution center.  Please note that reservations of vacation properties are a limited right of use so the owner may reserve the right to enter, occupy, use or share the property himself or with any third party, check the conditions of the list so that you will be aware of the owner's policies regarding the use and privacy in the property. It may also be the case that the host has not reserved the right of access to the property during the guest's stay, however he may have the right to access the property during that time in exceptional situations such as: (I) Situations of danger or force majeure that requires his entry to the property strictly necessary or by any other party such as government authorities, (II) Well-founded suspicion that a damage to the property is being caused,  (III) In the cases requested by the guest. (IV) In accordance with the provisions of the law of the jurisdiction that is located in the property.          

Keep in mind that as a guest you must comply with the vacation rental contract, furthermore not only the time for your stay is limited by the contract but also the number of guests who can enter the property is limited too. In cases where rules for the accommodation were breached you can be led to face friendly complaints and legal processes by the host.             

Incidents related to the trip such as cancellations or modifications of reservation, refunds requests or inconveniences during the trip will be regulated in accordance with the following rules.           

In cases where the guest wishes to cancel the reservation, it is regulated by the host policies established in the listing, in every case the refund will be made discounting the penalty established, plus Bungalulu's fees, any bank charges, plus those generated by taxes or due to the exchange of the currency, or any other expenses that Bungalulu had incurred before or during the reimbursement process (if applicable). Please note that the use of banking platforms generates a commission for banks or online-banking companies and once a refund is requested, Bungalulu want to help you get your money back, however, the user accepts and acknowledge the amount discounted by any Cancelation Policy, Bungalulu's fees, bank commissions, or any other expenses that Bungalulu had made before or during the reimbursement process (if applicable), and any other commission for currency exchange or taxes that has been anticipated and paid to the authorities,  if applicable, are not refundable.           

The host and the guest accept and acknowledge that they are solely responsible when modifying a reservation and they also undertake to pay any additional charges that the system generates, such as service commissions, bank or online-banking commissions and those derived by taxes of law.          

The guest recognizes and accepts that he is solely responsible for treating the property with care, maintaining a reasonable level of cleanliness and not being abusive or neglectful, therefore he must deliver it in the same good conditions in which it was delivered, he also undertakes to comply with the policies related to the number of guests or visitors allowed or any other that limits the use or access to the property,  as well as he undertakes to deliver the property by the time and date agreed for it, and not to exceed this period unless there was made a new confirmed and paid reservation through Bungalulu.com platform. The guest accepts and acknowledges to pay the amounts resulting from the damages caused to the property by negligence or intent made in the period of his stay and that were his own responsibility. It also undertakes to comply with all legal, moral and coexistence regulations of neighbors. The guest is solely responsible for its visitors including minors and to keep their documentation in order by the time of their stay in the property.         

Both the host and the guest accept and acknowledge that Bungalulu.com provides an online platform service and therefore user's personal information such as photo id, telephone numbers, property address, etc., remains in our server until our contract of use is valid, however Bungalulu is not a police agency, nor have access to user's psychiatric records or perform criminal backgrounds to anyone,  therefore Bungalulu is limited to create a accountable community through the ratings of users, on the grounds of which users acknowledge and agree that they release Bungalulu from all responsibility for any personal problem that they were victims due to faults or crimes committed against them while using the platform or the leased property,  before, during or after their stay in the property, that were not committed for Bungalulu or its workers.  Also the Host and the Guest acknowledge and accept that they are solely responsible in those circumstances mentioned above, furthermore they release Bungalulu from all responsibility in cases of claims by defamation, libel or injuries of any kind, acquired illness, partial or permanent disability or in those of preventive police detention, prison or prison sentence or verdicts to pay amounts of money or in cases of death of someone that are related to the use and enjoyment of the leased property through the services provided by the platform Bungalulu.com.          

As a Host you will be able to list your property in our platform once you have created your user account and you will have the opportunity to establish your policies regarding your listing, you will also be entitled to receive the payment whenever users rent your property according to our payment rules.        

The host undertakes to actively participate in the platform regarding the listings that he has already active, he must respond promptly and coherently to the questions and requests of the users and to comply with the policies established by Bungalulu.com. In all cases and especially those of intentional or non-compliance circumstances by the host, Bungalulu reserves the right to review, modify or delete the listings published by the hosts or in any case delete the aforementioned host account permanently.    

The Host undertakes that once the reservation has been accepted and paid by the guest to Bungalulu, he must comply with what has been agreed with the guest, by virtue of the fact that both (Host and guest) recognize that once the reservation has been accepted and paid, a bilateral and binding contract has been formed, and it is the exclusive responsibility of the host and the Guest to comply with their duties, with the exception of Bungalulu's duties. Therefore, the host undertakes to provide the service offered and to allow the use and enjoyment of the property in the terms established for the guest in the listing. The Host acknowledges and agrees to have deducted any fees amounts established for the use of Bungalulu.com platform, taxes of law or any other related to bank commissions, online banking or for the exchange of the currency if applicable.          

The users declare and accept that in cases of natural disasters, filth, earthquakes, hurricanes, widespread vandalism, wars. or any other that interrupts or makes impossible the execution of the reservation contract, it will be annulled and the parties waive any claim in this regard. 

The users understand and accept that there is not an exclusive relationship or dependence with Bungalulu therefore by the simple fact of using the bungalulu.com platform no type of subordination, employment, agency or companies of any kind will be generated for Bungalulu, it's being understood that Bungalulu only acts as an intermediary in the online platform and therefore is providing an online platform service through bungalulu.com,  under monetary consideration for which it is authorized to receive payments on behalf of each of the parties and make the corresponding discounts to materialize the necessary payments to whoever corresponds in due opportunity and deliver the receipts or invoices.        

 The listings published by the hosts must be made individually for each property to be rented and cannot be duplicated, there is an exception to the rule only in cases where a property has more than one accommodation to be rented, different publications about the same property can be made with their own characteristics described, such as in the case of a building that contains more than one apartment or different and separated rooms to be rented. The listings must be true and explained in detail and must contain the information of the property and the host policies, such as: characteristics of the property, availability, price, property rules and conditions of its use, amenities, additional charges for cleaning services, resort quotes, or any other charge that is related to the reservation of the property.  The host undertakes to keep the listing updated, including any information, photos or videos of the property and to discard in a timely manner the dates on which the property cannot be occupied through the calendar of the bungalulu.com platform.       

Both the host and the guest understand and accept that Bungalulu reserves the right to keep confidential data such as the property address, user’s email, owner and guest contact information, phone number, etc. Bungalulu reserves the right to keep confidential information such as phone number, property address or any other that Bungalulu considers convenient, until the reservation and payment has been made, in such a way that the exchange or disclosure of the aforementioned information by the users of the platform is prohibited before the payment of the reservation is made.  The users accept and agree that any kind of communication made out of Bungalulu's platform will be considered a fraud against our system and our user's community, furthermore both parties undertake to communicate exclusively through Bungalulu.com.  Bungalulu takes rules very seriously, so keep in mind that in any case of rule's violations, further action is going to be taken, and it could end up with a permanent account suspension.     

The Host understands, acknowledges and accepts that Bungalulu does not require from hosts to submit a valid property insurance policy to list their property, it is the host sole responsibility to comply with the law, and his own choice to buy the insurance policy whether or not it is required by law, to pay it and to maintain it to be covered by any loss, loss of profit, damages or liability that may occur with respect to the stay of the guests in the property for the agreed period of time. Likewise, the host acknowledges and accepts that he releases Bungalulu from all responsibility for any criminal, civil or administrative claim as well as for all amounts of money claimed for any loss, damages or liability, loss of profit due to claims that occurred related to the leased property or guests, that the insurance company has totally, partially or not covered at all.       

The guest understands, acknowledges and accepts that Bungalulu does not require guests to have a valid  insurance policy for property damages, loss, loss of profit or liability the moment he is traveling or when he is enjoying the rented property. It is the host sole responsibility to comply with the law, and his choice to buy the insurance policy whether or not it is required by law, to pay it, and to maintain it to be covered by any loss that may occur during the trip or at the time of the stay in the property for the agreed period of time. Likewise, the guest acknowledges and accepts that he releases Bungalulu from all responsibility for any criminal, civil or administrative claim as well as for all amounts of money claimed for any loss, damages or liability, loss of profit due to claims that occurred related to the leased property or guests, that the insurance company has totally, partially or not covered at all.      

Bungalulu manages an online platform through its community of users which is based mainly on an organizational system, honest, transparent, efficient and that trusts in the good faith of its users, therefore Bungalulu does not require the submission of licenses or legal permits by the hosts to approve their listings on the platform,   however, the host acknowledges and accepts that he is solely responsible for managing the legality of its holiday rental business, therefore he undertakes to  prior seek legal advice under his own risk and sponsorship in order to know the law and regulations of the place where property is located in,  as well as to acquire the permits or licenses necessary for the implementation of the holiday rental of the property and its derived activities, to know the legal implications of the rental and eviction contract and any other incident that could affect it due to the business agreed with the guest, and also to get advice regarding privacy policies and how to manage appropriately guests information,  prior to making the publication in bungalulu.com. The host acknowledges and accepts that he releases Bungalulu from all responsibility for any breach of legal regulations in this regard.       

Cancellation Policy       

Bungalulu gives hosts the option of choosing one of three cancellation policies such as Flexible, Moderate, or Strict when listing the particular property. If the guest needs to cancel the booking, they can do it by clicking the cancel option for the particular booking on my trips.       

     
Flexible: Full refund 1 day prior to arrival.    

• Bungalulu service fees, banking fees, any other applicable fees or taxes, currency exchange fees are not refundable.      

• Cleaning fees are always refunded if the guest did not check in.       

• The Bungalulu service fee is non-refundable.       

• If there is a complaint from either party, notice must be given to Bungalulu within 24 hours of check-in.       

• Bungalulu will mediate when necessary, and has the final say in all disputes.       

• A reservation is officially canceled when the guest clicks the cancellation button on the cancellation confirmation page, which they can find in Dashboard > My Trips > Change or Cancel.       

• Cancellation policies may be superseded by the Guest Refund Policy, safety cancellations, or extenuating circumstances. Please review these exceptions.       

• Applicable taxes will be retained and remitted, if applicable.       
     

Moderate: Full refund 5 days prior to arrival.    

• Bungalulu service fees, banking fees, any other applicable fees or taxes, currency exchange fees are not refundable.      

• Cleaning fees are always refunded if the guest did not check in.       

• The Bungalulu service fee is non-refundable.       

• If there is a complaint from either party, notice must be given to Bungalulu within 24 hours of check-in.       

• Bungalulu will mediate when necessary, and has the final say in all disputes.       

• A reservation is officially canceled when the guest clicks the cancellation button on the cancellation confirmation page, which they can find in Dashboard > Your Trips > Change or Cancel.       

• Cancellation policies may be superseded by the Guest Refund Policy, safety cancellations, or extenuating circumstances. Please review these exceptions.       

• Applicable taxes will be retained and remitted, if applicable.       
     

Strict: 50% refund up until 1 week prior to arrival.    

• Bungalulu service fees, banking fees, any other applicable fees or taxes, currency exchange fees are not refundable.    

• Cleaning fees are always refunded if the guest did not check in.       

• The Bungalulu service fee is non-refundable.       

• If there is a complaint from either party, notice must be given to Bungalulu  within 24 hours of check-in.       

• Bungalulu will mediate when necessary, and has the final say in all disputes.       

• A reservation is officially canceled when the guest clicks the cancellation button on the cancellation confirmation page, which they can find in Dashboard > Your Trips > Change or Cancel.       

• Cancellation policies may be superseded by the Guest Refund Policy, safety cancellations, or extenuating circumstances. Please review these exceptions.       

• Applicable taxes will be retained and remitted, if applicable.       

        

Penalty       

If the host cancels the booking without an unjustified reason after it has been accepted and paid by the guest to Bungalulu, the host is responsible for a penalty. The penalty will be also applicable to the expired booking request which was not answered. The host penalty will be applied by the following rules: 

• Host Cancellation made more than 7 days before check-in. US. $50 

• Host Cancellation  made less than 7 days before check-in.  US. $100 

• If the host did not respond (Accept / Decline) request Book. US. $50 

The admin can set the host penalty amount depending on the circumstances, it can be up to the amounts described above, but in any case, for an unjustified breach the amount would never be less than (US. $50). The host declares and accepts that the amount established for penalty can be discounted from future earnings through his account in bungalulu’s platform. In such a case the guest declares and accepts that he renounces the contract that has been formed with the guest, furthermore no complaint or legal action can be filed against any party for that reason. In those cases, the guest may get a bonus compensation not more than (US. $50). The compensation will apply just in those cases that Bungalulu was able to collect the host penalty, and the final amount would be credited in Bungalulu’s guest’s account in a period of time that could last up to 15 business days after the cancelation date, at every case the guest bonus compensation would be ruled by our payment rules and discounts. In cases where Bungalulu was not able to collect the bonus compensation from the Host, the guest will receive an email explanation in a period of time that could last up to 15 business days after the cancellation without acknowledgement of receipt.  The guest declares and accepts that no further complaint or legal action will be filed for that reason.    

The Host acknowledges and accepts he has gotten prior legal advice under his own risk and sponsorship and he is responsible for determining and complying with his own local and national tax obligations, thus committing to determine, collect, remit and pay as well as to include in his price any applicable tax or other indirect taxes, tourism tax, taxes for the occupation of the property, income or any other.  The Host acknowledges and agrees that he releases Bungalulu from all taxes due, interests, fines or liability for non-compliance with any tax obligations that are his own responsibility to deal with it.       

 Bungalulu reserves the right to withhold payments up to the amount required by applicable tax law in those jurisdictions in which we are required to make such withholdings and payments on its behalf, therefore the host authorizes Bungalulu to collect and pay taxes on his behalf if necessary.  Also, the Host acknowledges and accepts that he can be charged with additional amounts of taxes that had not been previously collected but that are effectively owed to the Treasury, and it is the user responsibility to pay them. Additional amounts may be deducted even from the amount of money remaining in Bungalulu's user's account, or those accrued from business performed later.  The Host also acknowledges and agrees that he has nothing to claim from Bungalulu for withholdings and payments of applicable taxes, and that his only option for tax reimbursement consists of filing a claim for tax return under his own risk  and sponsorship, directly to the Department of Treasury. The Host acknowledges and accepts that Bungalulu may cease the collection and payment of taxes on his behalf at any time if it is considered as pertinent and prior notification sent to the email account of the affected party associated with the Bungalulu.com platform, without acknowledgment of receipt.       

 Both the Host and guest will have the opportunity to rate each other with respect to the service provided and about their behavior during the performance of the transaction or while the enjoyment of the service, right after it ends. Users undertake to review honestly and use an appropriate language, not offensive or violent,  always safeguarding morality and good habits generally accepted. Bungalulu reserves the right to modify or totally eliminate any rating that violates the regular development of our user's community or that uses defamatory, derogatory, racist, discriminatory or vulgar language. Bungalulu also reserves the right to suspend and permanently delete the account of users who deliberately violate this policy. However, Bungalulu is not responsible or certifies the veracity of any comments issued by users of the platform, therefore the users: host and guest acknowledge and accept that they release and exonerate Bungalulu from all responsibility for such reasons.              

The users of the platform acknowledge and accept that by the fact of the use and access to the platform, Bungalulu will be a recipient of information and content that has been sent directly by them, including data, photos, videos, etc., therefore the users agree that the content is true and that they have the full authority to send and publish them either as the case may be,  therefore they are not infringing any intellectual property rights or copyright that could affect third parties, and also the users acknowledge and accept that they grant a non-exclusive, perpetual, royalty-free, irrevocable, sublicensable worldwide license, which may be transferred, copied, modified through derivative works from the original, as well as distribute, export or publish without any other limitation than those derived from the user agreement and Bungalulu.com.   In any case, if there is a violation of any intellectual property rights or copyright regulations or if the content turns out to be obscene, violent or offensive to people, the user accepts and acknowledges that such violation will be his sole responsibility and that he releases and exonerates Bungalulu from any responsibility in this regard.         

Users authorize Bungalulu to use the help of  software for the purposes of translating the content into many languages and accept and acknowledge that it is their sole responsibility to warn Bungalulu of any errors in the translation or misrepresentation of terms that may be harmful to publications. In such a way that the user accepts and acknowledges that he is solely responsible for such a fact and that he must review the listing in all the languages provided by Bungalulu.com, relieving and exonerating all responsibility to Bungalulu in this regard.     

When a user pretends to initiate a claim against other user must do so first thought Bungalulu's dispute resolution center in a period of time not more than 5 business days after the checkout date that was set up for the stay or 5 business days after getting the incident. Failing to do so timely, or by omitting these mandatory steps, the other party will be considered released of any responsibility about that claim.    

When the user considers that another user has to be held responsible for a particular claim, the user undertakes that prior to file any legal action in Court or Government Agency he must file a dispute against the Host or Guest thought the mandatory  Bungalulu's dispute resolution center, by sending an email to dispute@bungalulu.com filing a complaint and requesting a ticket number, in addition to the evidences that support the case.  The user must explain the facts why he considers the other user has to be held responsible for the incident. The user also undertakes to wait for Bungalulu's final decision in a period of time that could last up to 30 business days. The user declares that he will be held responsible by omitting these previous steps before filing a court case against the other user or any other administrative claim through government agencies, with the exception of criminal cases against people or in cases that public interest is being affected. The user acknowledges and agrees that he relieves and exonerates to the other user of any responsibility about that claim and he renounces to any amount of money claimed or compensation of any kind, or any kind of responsibility that he pretends the other user to be held, in the case that the claiming user has omitted this mandatory dispute procedure namely:  Bungalulu's dispute resolution, or by the fact that the user initiate the claiming procedure but without sending the evidence to support the case while filling the claim, although the user had access to those probationary elements by that time, in those cases the user accepts and agrees that any legal action against the other user that does not follow the rules established above will be considered a reckless action since it violates the party’s rights agreement in order to make up their differences in a previous friendly way. The user accepts and acknowledge that any legal action attempted against the other user either in court or through government agencies that does not follow these rules, will be considered null because of the violation of the parties' agreement, and the user accepts he would be held responsible for the expenses that the other user may have incurred in order to defend himself in such a case.

Failing to do so timely, or by omitting these mandatory steps, Bungalulu will be considered released of any responsibility about that claim.    

When the user considers that Bungalulu has to be held responsible for a particular claim, the user undertakes that prior to file any legal action in Court or Government Agency against Bungalulu, he must file a friendly complaint thought Bungalulu's Friendly Claiming Procedure, by sending an email to friendly@bungalulu.com filing a complaint and requesting a ticket number, in addition to the evidence that support the case.  The user must explain the facts why he considers Bungalulu has to be held responsible for the occurrence. The user also undertakes to wait for Bungalulu's final decision in a period of time that could last up to 30 business days. The user declares that he will be held responsible by omitting these previous steps before filing a court case against Bungalulu or any other administrative claim through government agencies. The user acknowledges and agrees that he relieves and exonerates to Bungalulu of any responsibility about that claim and he renounces to any amount of money claimed or compensation of any kind, or any kind of responsibility that he pretends Bungalulu to be held, in the case that the user has omitted the mandatory Bungalulu's Friendly Claiming Procedure, or by the fact that the user initiate the claiming procedure but without sending the evidence to support the case while filling the claim, although the user had access to those probationary elements by that time, in those cases the user accepts and agrees that any legal action against Bungalulu that does not follow the rules established above will be considered a reckless action since it violates the party’s rights agreement in order to make up their differences in a previous friendly way. The user accepts and acknowledge that any legal action attempted against Bungalulu either in court or through government agencies that does not follow these rules, will be considered null because of the violation of the parties' agreement, and the user accepts he would be held responsible for the expenses that Bungalulu may have incurred in order to defend Bungalulu in such a case.     

Applicable Jurisdiction.     

‎Regarding any dispute arising from the use of Bungalulu’s platform, vacation rental contracts or the application of this agreement and its various supplementary policies, against users or Bungalulu, that the user pretends to file in court, the user declares, acknowledges and agrees to attempt and file his pretended legal action only after attempting and finishing our Bungalulu’s dispute or friendly procedures, either the case corresponding, and solely and exclusively in a Federal Court of the Western District of New York, City of Buffalo, USA. ‎    

Finally, the user accepts and acknowledge that this agreement is not and adhesion contract and he has had enough time to find legal advice and ask for questions to Bungalulu or to request clauses’ modifications to contracts@bungalulu.com, before signing up in bungalulu’s platform, likewise, he declares he had read and understood the meaning and effects of this contract, furthermore by signing up in bungalulu’s platform the user has given his total acceptance to comply with all these regulations.
